General Terms & Conditions of
Canvas Rewards Loyalty program
These General Terms and Conditions apply to the Canvas Rewards Loyalty Program executed by the limited liability company “Hili Properties” hereinafter called: Hili Properties LLC through the Participating Hotels. These General Terms and Conditions shall govern and form an integral part of all agreements concerning Canvas Rewards and of all offers of Hili Properties LLC.
The Canvas Rewards Loyalty Program (hereinafter called: Canvas Rewards) rewards guests who frequently stay in Canvas Hotels and Resorts and tightens the relationship between the individual hotels and their guests and endeavors to create loyalty to the Canvas Hotels and Resorts brand.
The Participating Hotels in Canvas Rewards are Canvas Hotels and Resorts brands, (hereinafter called: Participating Hotels). Hili Properties LLC will announce every new Participating Hotel or hotel chain or any other participating partner.
All announcements will be made at the website of Hili Properties LLC, Canvas Rewards Loyalty Program located at (hereinafter referred to as the Canvas Website). Communication will be in English and/or in Russian.
These General Terms and Conditions supersede and replace all previous terms and conditions and can be changed at the sole and absolute discretion of Hili Properties LLC.
2. Canvas Rewards membership
Only individuals of 18 years and older may register as Canvas Rewards members and each individual may maintain only one account. A Canvas Rewards membership and its benefits are offered at the sole discretion of Hili Properties LLC.
To apply for a Canvas Rewards membership number the applicant will have to fill in all mandatory fields of the membership form supplied at a Participating Hotel and/or to register online at the Canvas website. A membership card bearing respective individual number will be assigned to each applicant. From that point an individual becomes eligible to earn Canvas Rewards points. The Canvas Rewards membership will be only be completed when the Canvas Rewards member receives his/her individual Canvas Rewards membership card.
Each Canvas Rewards member is responsible for the accuracy of his/her personal data. If any changes in names, addresses etc. occur a Canvas Rewards member is obliged to inform Hili Properties LLC.
There are different levels of Canvas Rewards membership under which are the Silver level and the Gold level. Hili Properties LLC is free to remove or to add new or modified levels or sublevels of Canvas Rewards membership or to grant special benefits without notice. Every Canvas Rewards member can be upgraded or downgraded at the sole and absolute discretion of Hili Properties LLC. The guidelines as to the upgrading and downgrading are published on the Canvas Website.
Silver Level member who stayed more than 50 nights during a calendar year will get to Gold Level and stay there for the rest of the year and the whole next year – during the next year they will need to collect another 50 nights to stay on this level after the next year.
Silver Level member who has organized more than 5 groups with 10 rooms each and 1 night stay minimum, or 5 conference or catering functions during a calendar year will get to Gold Level and stay there for the rest of the year and the whole next year – during the next year they will need to organize 5 more groups 10 rooms each 1 night stay minimum, or 5 conference or catering functions to stay on this level after the next year.
Acquired membership cards and Canvas Rewards points remain the property of Hili Properties LLC. They are for the Canvas Rewards members benefit only and may not be transferred to anyone. Lost membership cards should be reported by the respective member at the Canvas Website. The guidelines for the request for a new card are published on the Canvas Website. The Canvas Rewards member has to obtain a new card at Participating Hotel or by express mail (expenses for payment are the responsibility of the participant).
Employees of Canvas Hotels and Resorts, Canvas Hotel Shymkent, Hili Properties LLC, Fabulous Abu Dhabi Hotel Management or Royal Group and their subsidiaries are ineligible to participate in the Canvas Rewards program.
3. Membership discontinuation
A membership account may be closed at the sole discretion of Hili Properties LLC if no Canvas Rewards points are accrued during a thirty-six (36) month period. All Canvas Rewards points in the account will be forfeited at that time.
The Canvas Rewards member may terminate his/her Canvas Rewards membership at any moment in time on the Canvas Website. The Canvas Rewards points remaining in the account will be forfeited.
In the case of fraud or abuse involving Canvas Rewards membership, reward use, or a Participating Hotel, Hili Properties LLC has the right to take appropriate administrative and/or action and all Canvas Rewards points earned through Canvas Rewards will be forfeited, the Canvas Rewards membership will be terminated and the account closed.
The Canvas Rewards membership, including any reward certificates or any voucher that may have been issued to a Canvas Rewards member, may be revoked or suspended at Hili Properties LLC sole discretion if a Canvas Rewards member fails to pay any accounts at Participating Hotels.
4. Canvas Rewards Points
A Canvas Rewards member is eligible to receive Canvas Rewards points for staying at a Participating Hotel for his/her guest room and up to two additional rooms, as long as these rooms are occupied by immediate family members, relatives and friends of the participant. All these rooms must be reserved and registered in the Canvas Rewards member’s name and the Canvas Rewards member must make arrangements for payment of all rooms on a consolidated bill, which should be requested at the time of checking in. To ensure points are automatically booked to the members account the Canvas Rewards member should present his/her membership card at hotel check in or check out. Retroactive claims will only be awarded upon proof of stay at eligible rates in a Participating Hotel through the Canvas Website by sending an e-mail and follow all necessary Hotel requests.
The following charges do not qualify for Canvas Rewards points: room tax, banquet and catering charges (points for these expenses are charged according to special rules, which t excludes getting points for room and other individual additional expenses); laundry, taxi charges and non-eligible accommodation rates.
It is not possible for a Canvas Rewards member to receive Canvas Rewards points as well as other loyalty program benefits, such as Lufthansa Frequent Flight Miles, Nomad Club and etc. Canvas Rewards points cannot be changed into points for other loyalty program or the other way around.
Canvas Rewards points will not be given nor will reward be honored at any subsidiary or affiliate of Canvas Hotels and Resorts unless otherwise advertised. If a hotel ceases to be a Participating Hotel all stays subsequent to such date will not be eligible to earn Canvas Rewards points regardless of when the reservation was made.
Canvas Rewards points are awarded on all rates and through all channels of distribution with the exception of traditional wholesale rates booked through the Internet or through tour operators, Airline employee and/or Travel agency employee rates, coupons & voucher, prepaid rates, group, rates, booking on 3rd party Internet sites, package rates and long stay rates unless otherwise advertised.
Silver Card Members accumulate points for the dollars spent during their stay at participating hotels. Namely Canvas Rewards offers 11 points per dollar charged on the room folio for eligible rates, excluding room tax, paid-outs, banquet and catering charges, laundry, taxi charges.
Gold Card Members accumulate points for the dollars spent during their stay at participating hotels namely Canvas Rewards offers 13 points per dollar charged on the room folio on the eligible rates, excluding room tax, paid-outs, banquet and catering charges, laundry, taxi charges.
Canvas Rewards members can earn points for organising group, conference or catering functions.
To earn points for Group staying, member must book not less than 10 rooms per night. Member will earn 15000 points per night for group staying during week days from Friday until Monday, and 3000 points per night for group staying during week days from Tuesday until Thursday. For the catering and meeting room rental member will earn 5 points per US dollar spent for eligible charges, but maximum 50000 points per event. Non eligible charges are: Tax, audio-visual equipment, tips, decorations, flowers, props.
In order to earn points for Catering, a member must personally host the function.
Member will have the possibility to choose one of two – to earn points for his/her stay only or to earn points for group staying and/or conference or catering functions. It is not applicable to earn points for these two elements of Canvas Rewards program at one time. Rates of points exchange to the rewarding Events at Canvas Hotel Shymkent are mentioned in Attachment №2 to this General Terms and Conditions.
Canvas Rewards points will not be earned for a stay made prior to the date the members application was processed as shown in the records of Hili Properties LLC. No retroactive credit will be given.
No other person except the Canvas Rewards member may earn Canvas Rewards points for his/her account. Canvas Rewards points earned for a room shared by two Canvas Rewards members will only be awarded to one of them.
Hili Properties LLC is free to determine the amount of Canvas Rewards points given for each USD or other currency spent. The amounts will be shown at the Canvas Website. The amounts can be changed at the sole and absolute discretion of Hili Properties LLC and can vary for each level of Canvas Rewards membership. Canvas Rewards is furthermore free to reward Canvas Rewards members incidentally with (extra) Canvas Rewards points.
Canvas Rewards points can be redeemed for free stays at the Participating Hotels. Certificates for accommodation valid during certain period. The validity of the Canvas Rewards points will vary for each level of Canvas Rewards membership and will be shown at the Canvas Website.
Hili Properties LLC reserves the right to debit the account of any member who has acquired points unduly.
5. Other Benefits
In addition to Canvas Rewards points other benefits will be available for each level of Canvas Rewards membership.
Silver Members will have:
Special limited upsell surcharge of only 10,000 KZT per night for stay in the Superior Category of Rooms and only 15 000 KZT per night for stay in the Suite Category of Rooms.
10% discount on items excluding sundries at the Hotel Shop.
Free early check in upon availability
Priority on waiting list
Gold Members will have:
Free upgrade upon availability to Superior Category of Rooms and only 15 000 KZT per night for stay in the Suite Category of Rooms upsell.
10% discount on items excluding sundries at the Hotel Shop.
Free early check in upon availability
Priority on waiting list
Free late check out till 6pm upon availability
Guaranteed room availability for reservations booked 72 hours prior to arrival.
Benefits can be changed or rewarded, individually or collectively, at the discretion of Hili Properties LLC.
6. Redeem Canvas Rewards Points
Canvas Rewards members may redeem Canvas Rewards points only for free stays at the Participating Hotels; in rooms of initial category (Deluxe rooms in Canvas Hotel Shymkent for example). Rates of points exchange to the rewarded stay at Canvas Hotel Shymkent are mentioned in Attachment №1 to this General Terms and Conditions. The rate of exchange can be changed at the sole and absolute discretion of Hili Properties LLC.
Canvas Rewards members will be able to book any available room on the Canvas Website at any rate during any season, through the Canvas Website as long as they possess enough Canvas Rewards points to cover the room rate as mentioned on the Canvas Website.
Ordered awards are non-refundable and points used towards the awards will not be credited back to the account.
Lost, stolen or expired Awards will not be refunded, replaced or extended.
7. Reward certificate / reservation confirmation
To use Canvas Rewards points for a hotel stay at a Participating Hotel a Canvas Rewards member can make a reservation and choose that reservation that is eligible for Canvas Rewards redemption. The Canvas Rewards member will receive a reward certificate/reservation confirmation and present it at the Participating Hotel for which it is valid.
Hotel reward certificates/reservation confirmations can be issued by sending an online email through the Canvas Website or by express mail (expenses for payment are the responsibility of the Canvas Rewards member).
Canvas Rewards points will only be credited in case of a cancellation according to the cancellation policy available on the Canvas Website.
Vouchers for accommodation are neither replaceable nor redeemable for cash. Vouchers are valid for one year after the date of issue. Vouchers are transferable by prior arrangement with the hotel.
8. Privacy statement
Hili Properties LLC complies with the laws of the Kazakhstan and endeavors to protect all personal data of its Canvas Rewards members according to the law of Kazakhstan, however to be able to fulfill its obligations under this agreement Hili Properties LLC will be obliged to send some personal data to countries which are not deemed to have an adequate level of protection by reason of their domestic law or international commitments that they have entered into, by the law of Kazakhstan. Hili Properties LLC will transfer only the strict minimum of data (which will include Canvas Rewards member acknowledges this necessity and agrees to this transfer of his personal data explicitly when entering into the agreement. All electronic transfer of personal data will be by means of secured lines.
In order to keep the Canvas Rewards member apprised of his/her Canvas Rewards membership state of account, Hili Properties LLC will send the Canvas Rewards members account, information necessary for administration purposes, marketing materials from Hili Properties LLC which will inform the Canvas Rewards member of special offers and products that Hili Properties LLC believes to be of interest to the Canvas Rewards member and marketing material from third parties that have a strategic marketing relationship with Canvas Rewards. As a participant in Canvas Rewards the Canvas Rewards member has consented to receive all of the types of information described above. However, the Canvas Rewards member may at the time of registration or any other time revoke his consent and ‘opt out’ of such mailings and direct marketing activities (it is necessary to send an appropriate e-mail through the Canvas Website).
9. Tax liability
Canvas Rewards points, rewards, or others favors earned through participation in Canvas Rewards program may be subject to tax liability. Any tax liability, including disclosure, connected with the receipt or use of Canvas Rewards points, rewards, or others is the sole responsibility of the Canvas Rewards member.
In the event that any provision(s) of these General terms and Conditions shall be held invalid or unenforceable by a court of competent jurisdiction or by any future legislative or administrative action, such holding or action shall not negate the validity or enforceability of any other provisions which accomplishes – to the best possible extent – the original purpose of such provision.
Deviations from the General terms and Conditions shall only be binding if and in so far as this has been expressly agreed and only in respect of the offer or agreement to which they apply. These general Terms and Conditions shall remain fully in force with regard to all other offers or agreements.
Hili Properties LLC in authorized to make amendments to these general Terms and Conditions. The amendments shall become effective on the specified effective date. If no effective date is specified, the amendments shall apply as soon as a Canvas Rewards member is informed or becomes aware of the amendments.
For the purpose of these general Terms and Conditions, in writing shall be deemed to mean by letter, fax or electronic means
11. Governing law and Disputes
All offers, agreements and Canvas Rewards matters as well as these General Terms and Conditions themselves shall be governed by the laws of the Kazakhstan.
All disputes arising out of or in connection with Canvas Rewards, to which these General terms and Conditions apply, or the General Terms and Conditions themselves or their interpretation or execution, shall first be attempted to be settled though consultation and negotiation in good faith and in a spirit of mutual cooperation. All disputes that are not settled in that way within a period of thirty (30) days from the date the relevant dispute first arose may be submitted to the courts of Shymkent, Kazakhstan.
